The Failure of the 28-Clause Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the tension sparked by the introduction of a new comprehensive peace framework for ending the war appeared – briefly – to have been contained. A American diplomat spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, Moscow made its response: an extensive attack of missile and drone strikes on Kyiv.

The Pattern of Peace Talks and Military Action

The succession of contrasting events captured the grim essence of the outgoing year. By day, political struggles are conducted: hopeful statements are released from multiple capitals. Significant resources is expended on restraining particular approaches. By night, the Kremlin forcefully demonstrates the world that, for them, conflict continues to be the key method for achieving "resolution".

Nighttime Reality

As Russia's attack unfolded into the early hours of Tuesday, the present situation of Ukraine's exposure was laid bare. Ukraine is equipped to monitor missile launches from Russian territory, a capability provided through current data. From observation points, defense planes that had been dispatched to counter approaching cruise missiles flew past – sophisticated military planes supplied to Ukraine by Western partners.

Soon thereafter, Kyiv's missile defense engaged: defensive missiles targeted at a Russian ballistic missile. This was a advanced protection mechanism at work, probably provided by allied countries. Every deployment shakes the surroundings, causing tremors. The instant of fear quickly gives way to sober acceptance: perhaps the incoming missile won't hit its mark this time, protecting urban areas from devastation and another blackout.

Ongoing Risks

Following this, a large-caliber weapon opened up on a unmanned aircraft in the vicinity, part of a defensive team – probably Western-made equipment. Sadly, the projectiles didn't strike the opposing UAV – it maintained course toward its target.

With pauses, this carried on until dawn. Kyiv awoke to the early updates: multiple fatalities, destruction and infrastructure problems in multiple buildings as a result of the night's assault. As typically, everyone still continued their routines – experiencing conflict. But those 24 hours illustrated Ukraine's essential dependence on external assistance – a need that neighboring countries are evidently unprepared to fill in the near term.

Ineffective Peace Efforts

The detailed framework from American leadership sparked intense emotion, controversy and serious worry – and momentarily shifted focus from Ukraine's major integrity crisis in years. Yet, we have seen this script before, after previous diplomatic encounters and bilateral conferences.

Every new proposal from US leadership unfolds according to the same pattern: a political offensive against Ukraine, which Kyiv, with partner nations, succeeds in resisting. They contain the crisis but never actually achieve victory. This trend will, no doubt, continue.

Strategic Calculations

It is tempting to accuse specific actors of consistently pushing Moscow's conditions. But that does not seem to be the complete picture. American leadership operates on a principle well known to seasoned negotiators: you cannot win at the negotiating table what you have lost on the battlefield. The White House believes that it is impossible to compel Moscow to surrender the territory that it currently occupies in Ukraine's occupied territories.

The challenge is that while acknowledging this situation, US leadership does minimal to deter Moscow, through statements or actions, from thinking that the status quo will not change more in its favour in the months ahead.

Opposing Positions

Therefore, Russian leadership is convinced that duration works to their advantage – that Ukraine and its supporters are coming close to fatigue. Their motivation to agree to terms that does not give them the largest achievable advantage is almost completely absent. There may be multiple initiatives to stop fighting, but they will carry on as long as Russia's leadership remains completely certain in the outcome.

On the contrary, Kyiv believes that Ukraine can still hold out, slowly losing civilians and areas but avoiding a complete military breakdown until conditions improve in its advantage.

Present Conditions

Factually, there are no real preconditions for a truce. Now, individual motivations are coming into play: personal goals to mediate resolution and secure international recognition, and the government's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to rally Ukrainians around the flag against any proposal Kyiv finds unsuitable, so that their focus does not shift toward homefront challenges. And although their task will now be much harder after current events, it remains quite doubtful that this will alter their fundamental strategy.

These conflicting dynamics are influencing discussions.

Conclusion and Outlook

It took a just a single week to terminate the 28 points of the most recent proposal. Forceful and unpredictable management of the matter by American leadership, resistance by Ukraine and the rest of Europe, along with calming attempts of diplomats, and finally, current information leaks, all achieved their purpose.

While new plans based on established approaches are forthcoming, Kyiv, London and other allied nations should draw one fundamental conclusion: Ukraine and Europe will only be able to resist political attacks from Washington that are based on Russian demands and demonstrate specific hesitation to alter the situation, if they stand together and enhance their military capacity at a much faster pace. If they do, neither external pressure nor military threats will be able to break them. In the meantime, Ukraine's capacity to defend against evening bombardments will, for the coming months, mainly require continued Western support.
